1. Introductions

Welcome to Creative Artboard.
These Terms & Conditions (“Terms”) govern your access to and use of our design, advertising, and marketing services.
By engaging with us or using our website www.creativeartboard.com, you agree to these Terms in full.
If you do not agree, please do not use our Services.

2. Our Services

We provide professional services including but not limited to:

A. Information You Provide Directly

  • Graphic design, branding, and creative direction
  • Digital advertising and campaign management
  • Social media marketing and content creation
  • Website, print, and promotional design

All services are provided based on agreed project scope, timeline, and deliverables as discussed in written communication or proposal/quotation.

3. Client Responsibilities

You agree to:

  • Provide accurate information, materials, and feedback in a timely manner
  • Review drafts and proofs promptly to avoid project delays
  • Obtain necessary rights or permissions for any content provided
  • Make full payment as agreed in project quotation or invoice

Failure to provide necessary materials or feedback may delay project timelines, for which we are not responsible.

4. Payments

  • All payments must be made in the currency stated on the invoice or quotation.
  • Projects typically require an advance deposit (50% or as agreed) before work begins.
  • Remaining balance is due upon final delivery or milestone completion.
  • Payments can be made through Payoneer, Paypal and Bank Transfer

We reserve the right to pause or terminate services if payment terms are not met.

5. Revisions & Approvals

Unless otherwise stated in the project agreement:

  • Projects include [2-3] rounds of revisions after the initial draft.
  • Additional revisions may incur extra charges.
  • Final approval from the client constitutes acceptance of all deliverables.

Once approved, any further modification is considered a new request and billed separately.

6. Intellectual Property

  • Upon full payment, ownership of final approved deliverables transfers to the client.
  • We retain the right to display non-confidential work in our portfolio, social media, or marketing materials.
  • All working files (e.g., PSD, AI, INDD) remain our property unless agreed otherwise in writing.

7. Confidentiality

We respect your confidentiality and will not disclose project information, data, or materials to third parties without written consent, except as required by law.

8. Refund & Cancellation Policy

A. Project Deposit
  • The initial deposit or advance payment is non-refundable once the project begins.
  • This covers time spent on project preparation, research, and resource allocation.
B. Project Cancellation
  • If a client cancels before work starts, a full refund of any advance payment may be granted (minus transaction fees).
  • If cancellation occurs after project initiation, a partial refund may be issued based on work completed (typically 20-50% deduction). No refunds are available after final design approval or delivery.
C. Non-Delivery or Delay
  • If we fail to deliver within the agreed timeframe (without prior communication or valid reason), you may request a partial or full refund, depending on project status.
D. Marketing Campaigns
  • Due to the nature of advertising spend and third-party platform costs (e.g., Meta Ads, Google Ads), media budget payments are non-refundable once campaigns are launched.

9. Limitation of Liability

We strive to provide high-quality services, but we are not liable for:

  • Indirect, incidental, or consequential damages
  • Performance outcomes dependent on external platforms (e.g., social media reach, ad performance)
  • Client's use or modification of delivered materials after approval
Our total liability shall not exceed the total amount paid for the specific project in dispute.

10. Use of Third-Party Services

Our services may involve the use of third-party tools (e.g., Google, Meta, hosting providers). We are not responsible for downtime, pricing changes, or errors caused by these external services.

11. Termination

We reserve the right to terminate or suspend a project if the client:

  • Fails to make payments
  • Violates these Terms
  • Engages in inappropriate or unethical conduct

In such cases, no refund will be issued for work already completed.

12. Governing Law

These Terms are governed by and construed under the laws of Bangladesh.
Any dispute shall be subject to the exclusive jurisdiction of the courts in Dhaka, Bangladesh.
